5. Content Ownership & License

Your Content: You retain ownership of any text, images, GIFs, comments, and reactions ("User Content") that you post.

Our License: By posting User Content, you grant IsTheHypeReal a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with operating and promoting the Platform.

6. Moderation Rights

We reserve the right, but have no obligation, to monitor, review, flag, modify, or remove any User Content at our sole discretion, without notice, if we believe it violates these Terms or harms the community.

7. Intellectual Property

All rights, title, and interest in and to the Platform (excluding User Content), including our logos, design, code, and trademarks, are and will remain the exclusive property of IsTheHypeReal. You may not use our brand assets without written permission.

8. Termination

No Warranty: THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, ISTHEHYPEREAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF YOUR USE OR INABILITY TO USE THE PLATFORM.

10. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the applicable jurisdiction, without regard to conflict of law principles. Any disputes arising out of these Terms will be resolved through binding arbitration or in small claims court, waiving the right to participate in a class action lawsuit.
